1. Acceptance of Terms

By downloading, installing, accessing, or using the Canvas Ninja browser extension ("Extension," "Service," or "Software"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not install or use the Extension.

2. Description of Service

Canvas Ninja is a browser extension that provides the following features:

  • Privacy Guard: Modifies browser behavior to prevent web pages from detecting tab switches, window focus changes, and visibility state changes
  • Answer Saver: Retrieves and displays your previously submitted quiz answers from Canvas LMS for quizzes that allow multiple attempts
  • Canvas Toolbar: An optional on-page interface displaying protection status

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Service. By using the Extension, you represent and warrant that you meet this eligibility requirement.

4. Account Registration

4.1 Account Creation

To access premium features, you must create an account by providing a valid email address and password. You agree to provide accurate and complete information.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4.3 One Account Per User

Each subscription is for individual use only. Sharing account credentials with others is prohibited and may result in account termination.

5. Subscription and Payment

5.1 Subscription Plans

We offer the following subscription options:

  • Monthly Plan: Recurring payment of $9.99 USD per month
  • Lifetime Plan: One-time payment of $49.99 USD for permanent access

5.2 Payment Processing

All payments are processed securely through Stripe. We do not store your payment card information. By making a purchase, you agree to Stripe's Terms of Service.

5.3 Automatic Renewal

Monthly subscriptions automatically renew until canceled. You may cancel at any time through your account settings or by contacting support.

5.4 Price Changes

We reserve the right to modify pricing at any time. Price changes will not affect active subscriptions until renewal.

6. Refund Policy

6.1 Monthly Subscriptions

Due to the digital nature of the Service, monthly subscription payments are generally non-refundable. Refund requests may be considered on a case-by-case basis within 7 days of initial purchase if you have not used premium features.

6.2 Lifetime Purchases

Lifetime purchases are non-refundable after 14 days or after significant use of premium features.

6.3 Requesting a Refund

To request a refund, contact us via Discord or email with your account email and reason for the request.

7. User Responsibilities and Conduct

7.1 Compliance with Institutional Policies

YOU ACKNOWLEDGE AND UNDERSTAND THAT:

  • The use of this Extension may violate your educational institution's academic integrity policies, honor codes, or codes of conduct
  • You are solely responsible for understanding and complying with all applicable institutional rules and policies
  • We do not encourage, endorse, or condone academic dishonesty

7.2 Assumption of Risk

By using the Extension, you assume all risks associated with its use, including but not limited to:

  • Academic penalties (failing grades, course failure, suspension, expulsion)
  • Disciplinary action from your educational institution
  • Notation on academic transcripts
  • Loss of scholarships, financial aid, or academic standing

7.3 Prohibited Uses

You agree NOT to:

  • Use the Extension for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the Extension
  • Circumvent any access controls or usage limits
  • Resell, redistribute, or sublicense the Extension
  • Use the Extension in standardized testing, professional certification exams, or legally binding assessments
  • Share your account with others

8. Intellectual Property

8.1 Ownership

The Extension, including all code, design, graphics, and content, is owned by Canvas Ninja and protected by intellectual property laws. All rights not expressly granted are reserved.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Extension for personal, non-commercial purposes in accordance with these Terms.

8.3 Trademarks

"Canvas Ninja" and associated logos are trademarks. "Canvas" is a trademark of Instructure, Inc. We are not affiliated with, endorsed by, or sponsored by Instructure, Inc.

9. Disclaimers

9.1 "As Is" Provision

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY

9.2 No Guarantee of Functionality

We do not guarantee that:

  • The Extension will work with all versions of Canvas LMS
  • The Extension will be undetectable by all monitoring systems
  • The Extension will function without interruption or errors
  • Updates to Canvas LMS or browsers will not affect functionality

9.3 Third-Party Platforms

We have no control over Canvas LMS, your educational institution, or any third-party platforms. Changes to these platforms may affect the Extension's functionality without notice.

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANVAS NINJA AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Academic penalties, disciplinary actions, or institutional sanctions
  • Any damages arising from your use or inability to use the Extension

10.2 Maximum Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE EXTENSION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10.3 Basis of the Bargain

You acknowledge that these limitations are an essential element of these Terms and that we would not provide the Extension without them.

11. Indemnification

You agree to indemnify, defend, and hold harmless Canvas Ninja and its owners, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Extension
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of any institutional policies
  • Any academic misconduct allegations related to your use of the Extension

12. Modifications to the Service

12.1 Updates

We may update, modify, or discontinue features of the Extension at any time without notice. We are not obligated to provide updates or maintain backward compatibility.

12.2 Service Discontinuation

We reserve the right to discontinue the Extension entirely. In such event, lifetime subscribers will receive a prorated refund based on a 3-year expected service life.

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

  • Uninstalling the Extension
  • Contacting support to request account deletion

13.2 Termination by Us

We may suspend or terminate your account immediately, without notice, for:

  • Violation of these Terms
  • Fraudulent or abusive behavior
  • Non-payment
  • Any reason at our sole discretion

13.3 Effect of Termination

Upon termination:

  • Your license to use the Extension is revoked
  • You remain liable for any prior violations
  • Sections 7, 8, 9, 10, 11, and 15 survive termination

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via:

  • Email to your registered address
  • Notice within the Extension

Continued use after changes constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or the Extension shall be resolved through:

  • Informal Resolution: Contact us first to attempt resolution
  • Binding Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration under AAA rules
  • Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions

15.3 Jurisdiction

For any matters not subject to arbitration, you consent to exclusive jurisdiction in the courts of Delaware.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Canvas Ninja regarding the Extension.

18. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

19. Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
